Terms and Conditions

These Terms and Conditions govern your access to and use of Yap, including our mobile app, website, real-time translation services, subscription features, and support services.

1. The Yap service

Yap provides AI-powered real-time speech translation, translated audio output, captions, translation history, account features, and subscription-based minute limits. Yap may change, improve, suspend, or discontinue parts of the service at any time.

2. Eligibility

You must be at least 13 years old to use Yap. If you are under the age of majority where you live, you may use Yap only with permission from a parent or legal guardian who agrees to these terms.

3. Accounts and security

You may need an account to use Yap. You are responsible for keeping your account credentials secure, for all activity under your account, and for providing accurate information. Tell us promptly if you believe your account has been compromised.

4. Microphone access and translation output

Yap requires microphone access for live translation. You are responsible for obtaining any permission required before recording or translating another person's speech. Yap translations are generated by AI systems and may be inaccurate, incomplete, delayed, offensive, or inappropriate.

Do not rely on Yap as the only method of communication for emergencies, medical advice, legal advice, financial decisions, safety-critical instructions, immigration matters, law enforcement interactions, or other high-risk situations.

5. Your content

"Your content" includes audio, transcripts, translations, support messages, and other information you provide through Yap. You keep your rights in your content. You grant Yap a worldwide, non-exclusive, royalty-free license to host, transmit, process, reproduce, display, and create technical derivatives of your content solely as needed to operate, secure, support, and improve Yap.

You represent that you have the rights and permissions needed to submit your content to Yap and to allow Yap and its providers to process it under these terms and our Privacy Policy.

6. Acceptable use

You agree not to use Yap to:

• Break the law or violate another person's rights.
• Harass, threaten, exploit, defame, or harm others.
• Translate or transmit unlawful, abusive, hateful, sexual, or exploitative content.
• Reverse engineer, scrape, overload, attack, or interfere with Yap or its providers.
• Bypass access controls, quotas, subscription limits, or security measures.
• Use Yap to build competing models, services, datasets, or automated abuse systems.
• Misrepresent AI-generated translation output as human-certified or legally authoritative.

7. Plans, minutes, and subscriptions

Yap may offer a free plan and paid subscriptions. The current app configuration includes 5 free lifetime real-time translation minutes and Yap Premium with 120 live translation minutes per monthly quota period. Exact prices, taxes, renewal terms, trials, cancellation options, and refund options are shown in the app store purchase flow before you buy.

Subscriptions are processed by Apple, Google, RevenueCat, and related payment systems. You authorize the applicable app store to charge your selected payment method. Subscriptions renew automatically unless cancelled according to the app store's rules. Yap cannot cancel a subscription on your behalf if the app store requires you to manage it through your platform account.

Except where required by law or app store rules, fees are non-refundable, and unused minutes do not carry cash value. We may change plan features, quotas, or pricing prospectively with reasonable notice.

8. Third-party services

Yap depends on third-party providers, including OpenAI for AI translation, Clerk for authentication, Supabase for data storage, RevenueCat for subscription infrastructure, and Apple or Google for app distribution and payments. Your use of those services may also be subject to their terms and policies.

9. Privacy

Our Privacy Policy explains how we collect, use, share, and retain information. By using Yap, you acknowledge the Privacy Policy.

10. Intellectual property

Yap, including its app, website, brand, mascot, designs, software, text, graphics, and other materials, is owned by Yap or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use Yap for its intended purpose.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from Yap except as allowed by law or with our written permission.

11. Account deletion and termination

You may delete your account where the feature is available in the app or by contacting us. We may suspend or terminate access if we believe you violated these terms, created risk for Yap or others, caused legal exposure, or used the service abusively. Some terms survive termination, including payment obligations, intellectual property, disclaimers, liability limits, and dispute provisions.

12. Disclaimers

Yap is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

We do not warrant that translations will be accurate, that speech will always be detected correctly, that service will be uninterrupted, or that all errors will be corrected.

13. Limitation of liability

To the fullest extent allowed by law, Yap and its affiliates, providers, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or substitute services.

To the fullest extent allowed by law, Yap's total liability for all claims relating to the service will not exceed the greater of the amount you paid to Yap for the service in the three months before the claim or 100 U.S. dollars.

14. Indemnity

You agree to defend, indemnify, and hold harmless Yap and its affiliates, providers, officers, employees, agents, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of Yap, your violation of these terms, or your violation of another person's rights.

15. App store terms

If you downloaded Yap from Apple's App Store, Apple is not responsible for Yap or its content, but Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If you downloaded Yap from Google Play, Google is not responsible for Yap or its content. App store terms may also apply to your download, purchase, subscription, refund, and device use.

16. Governing law and disputes

These terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law principles, unless the laws where you live require otherwise. You and Yap will try to resolve disputes informally first by contacting ty@friendlytech.org.

17. Changes to these terms

We may update these terms as Yap changes. If an update is material, we will provide notice through the app, website, or another reasonable method. Continued use of Yap after changes become effective means you accept the updated terms.
